Quit Claim Deed
QuoteReply

I have a quit claim deed for my home which has made it, as a currently married woman, my separate estate.

Question: how does that factor into community property or does it?

Yes, it can FIGURE IN but that only means that it is one factor.  I have a couple cases right now where the quit claim granted the other party sole title; but in both cases they did it while they were STILL MARRIED and without simultaneously executing a property settlement agreement notarized or with lawyers, and THEN ALSO entering that separation agreement with the final divorce decree.  and also..... in both cases they did the transaction for reasons of financing, and in one case they had an idea to finish off the divorce but then just messed around for a year and moved back and with each other.  So it does not establish your final right to that property.  If the two of you had already done other things with joint assets in terms of separating them then it could be deemed to be just one more facet you guys' settlement, ie your intentions manifest by actions.

in washington state ALL property of both parties can be divided by the court even if it has separate character.  if you purchase a boat before the marriage it has a separate character.
