Do we have to payback spousal maintenance?

My fiancee was awarded spousal maintenance in her divorce. She received her check at the beginning of this month and we are getting on the 28th. So my question is, does she have to pay back the funds she received for February spousal maintenance or is it hers? No prorating or concerns about her ex wanting her to pay back for the whole month?

Well, let's see. My question was posted in February of 08 so it's really not relevant anymore. And my question was really about legal obligation and not about legal strategy. Even though I feel as though I have been chastised for asking a sincere question, I'll clarify my question.

My Fiancee' received her spousal maintenance check for the month of February 2008. We were married on the 28th of February. My question is quite simple and sincere. By law, is the maintenance payment hers once it is received or Does she need to pay back one day of maintenance (the 29th of February) or the whole amount?
