That's not true. It does happen from time to time that the couple get back together on a crazy moment and start living together again and having sex.... and pregnancy hits during the divorce or sometimes she is pregnant before filing... i had a case one time involving this... because of the circumstances we filed a motion for "joinder of actions/claims" and had the paternity test done also... when i say we ... i mean it was an agreed joinder of a a paternity action proposed by the other lawyer (the father's attorney) 'cause obviously we knew my client was the mother... but he had been with others... so we actually had to fight over custody of an unborn child ..... when divorces are finalized you must state your knowledge of whether the wife is or is not pregnant, you also must list ALL the children.
You probably need to do a paternity test b/c children born during divorces ...and right on the cuff as this case appears to be from you very brief statement... are presumed to be the husband's. it's not the end of the world in terms of fees and stuff but the average paternity test is about $250-450 which is not cheap.
