financial fear
QuoteReply
Nutshell:
Woman
Married at 18 years old - now 43. He was 26 now 51.
Moved 16 times in 9 years following his job.
Married 25 years.
No career or job.
I have managed finances for the last 21 years.
Lived at home with kids while he worked out of town 6 weeks home for 4 days.
Want out. No relationship. Always says he wants to teach me.

He gets mad and tells me he'll give me the bare minimum and that his responsibility is to our daughters (20 & 17) and that he owes me nothing. I could have it all if I just stayed - I am the one leaving... Having it all means more of the same. I have been lied to many times and no longer trust him. Lots of mind games and blame.

He knows I want out and keeps saying I will have nothing. He constantly mentions the economy and that I would never get a house on my own and that that is not his problem. I supported him by holding down the fort so to speak. He makes $85,000. with no college education. After one of these conversations, I am a basket case and can barely think. Counselor said I have anxiety...big surprise there. Lol.

I am going to go to a class called second Saturday. It is supposed to be a class with a counselor, a mediator and a divorce attorney. I hope it helps. Most attorneys give what I call teaser information...I just want to know what I can expect for support. I am also afraid that he is the type that would just up and leave (to South America) and I wouldn't get support court ordered or not. So maybe my desire to know is a moot point.

We have been separated since July 2007. We are in the same house but in different rooms. Our teenage daughter lives with us but wants to live with me and if I don't do something, wants to get out and get an apartment with whoever she can make it work with.

I feel like an 18 year old again. Trying to decide what I want to be when I grow up only now I am 43 and know what life costs and the thought of being on my own tomorrow scares me.

Any info?

you have not been separated since july 2007 because you are living in the same house.

you stated: "...Most attorneys give what I call teaser information...I just want to know what I can expect for support..."

is the time and energy that went into my site and discussion board "teaser information"?

...;)....

...ok.. i've got to tell you that posts like these are just fine and i wish i had time to do the work up that a complicated and long history of circumstances like this deserves... but the reason you probably felt other lawyers were only offereing "teaser info" is that unlike 75% of the posts /issues/discussions/complaints re the system/ subtle issues of law what have you... is that $500 worth of attorney is totally required to give you a safe and reliable answer... it's not sth. like... does a legal separation require the 90 day wait period? or can a legal sep. be totally nullified by moving back into the ex spouses home? (answer = flat yes, which is different from the formal financial separation that occurs w/ a divorce) ...

you shouldn't expect a good answer off a free consultation phone call w/ a lawyer ... you obviously are only going to get "teaser information" or worse....... you won't get the full workup or x-ray or cat-scan or blood pressure and all the tests a 20+ yr marriage case with high conflict and 2kids and a stay at home mom deserves... and the $500 it requires is sth. they can't even give you over the phone if they wanted... so i guess that's what my last post is trying to tell you is don't be ticked off when i punt on this one... but i will say that you will certainly get support and some help retraining and what not.. also it is imperative for you to know that you are a very good candidate for an early "attorney fee award" based on the " need and ability to pay stnd. " ... .. that test is actually four factored but you could file a motion on two weeks notice and i bet you'd get anywhere from $1500-2500 awarded you in atty. fees from the husband like pronto on the spot.. when i first started practicing...

.. about ten years ago i took a few cases just like yours on zero retainers b/c i believed i could get an order for atty fees... wow.. i remember one case in 1998 i got $1500 awarded and even still this jerk was like "no.." .. don't have it... journeymen construction craft strong 4k per year.. wife has zip experience and a 12 and 7 year old.. 13 yr. marriage... i garnished his wages after they stalled for 2 months, when his employer came in and said you don't get your full pay check.... i got a call from his attorney ..(who by the way quit the practice of law about 7 years ago...)...
