Residency myth?
QuoteReply
I'm currently deployed to Afghanistan, and upon return will be stationed in Germany. I haven't lived in Washington since I joined the Army 4 years ago, but I was told that since I'm originally from Washington, and my home of record is still listed as Washington, I'm technically still a resident as far as divorces are concerned. Is this true?

yes, most likely from what you've stated: YES, YOU ARE INDEED STILL A "DOMICILIARY" OF THE STATE OF WASHINGTON!!! ... i'm writing a brief and essay analyzing the history and legal errors many here in WA have made (be there legislative, forms generation in olympia, judges, clerks, misinformed lawyers practicing law by supersitition, etc. etc) ...it will function as a helper course and perhaps part of a CLE i suppose if such arcane topics could get enough attention....  but i can't help them for free that much!!

... i could write this post for hours, but here: "you got to renew it to lose it". that i made up but it's helpful.  the old federal case law informs so well (and is in part "controlling precedent" as we call it) on the issue of "residency" (knowing law by superstition but still being a legislator in olympia) and domicile. domicile requires intent to make your new physical abode of germany your permanent "home" and other characteristics of permanancy...  most military even when 10yrs abroad intend to come back... so you COULD NEVER HAVE ACQUIRED A LEGAL DOMICILE STATUS FOR PURPOSES MANY AND DIVORCE BEING ONE INCLUDED!!! and having not given birth to it anew, you did not lose your first child of WA. ... i'm tired ..gotta go...hope this helps and if you're a ranger I give special ranger discounts....
