my husband does not live in washington and has not for a long time.  i have been out state temporary and moved here only a few months ago. i don't have a license.  can i still file in washington even though we were not in fact married here?

Washington state divorce law only requires that one party be a resident for there to be jurisdiction over the marriage.  You don't need a license.  If you have been here for three months and have the intention to make washington your home, you are a washington resident for purposes of divorce law.  Where you were married is irrelevant, you could have been married in another county.

However, if neither party is a resident you can not do the divorce here.
