Essentially, i need help provving emotional instability and how this makes the mother not an unfit parent but less of one, so to speak, than me.  unstable is not the word, angry is and psychotic is.  the verbal abuse and manipulation does not end.  She is self-righteous and has a sense of entitlement that I never anticipated.  my son loves his mother but how do i prove this effect on him. hiring a lawyer for $3000 up front is not an option right now. she has never been convicted of anyting, neither have i.  there are a few of my friends that would testify that she sets a very bad example but i don't know if that will do it.  we are sharing custody right now but she recently has instituted a "plan" that she says that "you know" is in his interests, which means i just get him 3 days out of 14 and i just know i am more of a benefit to him than her.  could someone share there experience on what they did to get main custody?

You could ask for a psychological evaluation.

The court can appoint a psychologist to prepare a report regarding both parties mental and physical health and general fitness as parents.  They regularly appoint such experts who are skilled in child development psychology. they meet with the parents and the children and other persons related to the children and interview teachers and generally just investigate both parites and then report back to the court as to what has been going on.

they then make a 5-15 page report to court on what the best custody schedule for the child is.

check the credentials of the providers there are good GALS (guardian ad litem), psychologists, in both seattle and bellevue.  most are versed in washington custody law as well.

Rewrite the parenting plan, to give you more time with your son. This looks like you are making a positive influence on the living arrangements. File it! I used an online software www.kids-first.com and it was AWESOME. I changed the parenting plan, (it was old anyway) and I established a benchmark that my children needed more time with me, due to exes unstable home life. He didn't even respond. Good Luck!
