I have asked my husband to leave on a number of occasions. I've wanted a divorce for years but he will not leave the house! We have three children. He is verbally abusive - frequently telling us to shut up or - more likely - shut the
F@#$
up. I want to end this marriage but keep the house as it is close to the kids school. How do I get him out of the house?

You can make a motion on 14 days notice requesting the court grant an order that you be allowed to stay in the home with the children for the next 10 months or so pending trial and while the divorce is being settled. It will probably be granted. However, a temporary restraining order is probably not appropriate if there is no actual physical violence.
