how soon can i get a custody document?

my case document shows that i have a trial 11 months and 5 days from the date of yesterday.  that is just ridiculous.  there is no parenting plan so the police i have called say that it is a civil matter.  what are my options?

usually it take a week or so to collect the evidence and prepare the motion. but i usually have people in court within a month. if you have an emergency situation (and you must have circumstances which justify it) you

can go into the "ex parte" department without notice to the other side and attempt to explain the reason why you should get custody prior to the other spouse without their knowledge for a very temporary period before both of you

appear for another hearing.  i usually do not do this b/c most cases do not warrant it; and if you do it improperly it can have a bad effect. if either party is unstable; or may leave the state with the child; or drugs are involved; or domestic violence threats, then i will consider it.
