Does my ex's attorney really need my spouses income information?

I have been divorced for @ 5 years now. I recently filed a motion for modification of child support fot the first time on August 8,2007. Both the CSD case worker and the District Attorneys office said that the calculation is based on mine and n\my ex's income only. As of todays date of 4/1/2008, it has yet not been completed due to my ex's attorney. A total of 9 months now (I do not have one as no one will present me due to "conflict of interest" of knowing his attorney, which makes it difficult for me). I recently received a letter from him asking for my spouses income paystubs and his W-2's. He states that he needs this pursuant to RCW 26.19.071 (1). If you look at it, it says it is only based on parents of children and not other people in household and in (4) it states that income of new spouses and other adults in household are excluded.

Is he trying to pull the wool over my eyes and just be nosey? The child support has only been based on his and my income only.

Should I bring this to his attention? Do I have to hand over my husband's income information after I have been told that it is not needed? How can I get this to come to a closure with his attorney without this continuing on like it has been. I feel like I am getting another divorce.
