My son will be 6 in November and his dad and I have been separated for 3 years. Never been married. I originally was going to go to court to get full custody but his father and mother always threatened me and made me afraid I would never get custody of my son. I have never done anything to harm my child in any way and make descent money. His dad pays child support after I filed because I wasn't receiving any help and his mother was paying all his bills. His dad has been addicted to Methadone, vicodine and percocet for years and is now going to these meetings. He says he has been clean now for 3 or 4 months which I'm happy for him but do I need some kind of proof he was addicted? He used to fall asleep at the wheel all the time which always frightened me that he would do that when he was with his dad. He was in like 3 accidents in less than a year! His father works out of town sometimes like last year 2008 he was gone from July to November. I think he came home two days a couple of times to visit him and that was it. My child lives with me full-time by the way. His dad wants Joint but I don't see my son being taken care of as well as I have taken care of my son.

Also my son's dad accidently broke my son's arm last year from throwing him on the bed (playing) and I'm being garnished 500 a month for that bill. He refused to help. Also he was laid off from December to end of April and I didn't see a cent. Division of Child Support tried to call him many times to pay up cause he was on unemployment but still never saw anything.

If I got to court will I have a good chance of getting custody?
