we dont have a custody document or parenting plan? if I keep the child in my care and don't let her see the child because she is unstable is that contempt?

no.

you can't have contempt without and order.

but you had better have a good reason for doing it or the court could make provisions that reflect an unreasonable withholding of the child from the other parent.
