I live in Denver. My 7 year old is in Washington living with her father. Well, so I thought until 2 months ago. I flew in to visit and found a new breathalizer in the father's car (this will now be his 2nd DUI!). He told me he was not convicted of anything and it was temporary during his trial. ? huh? So I wasnt all that worried because he lives with his parents and I know they are there helping with her. But now, I find out from his mother that she kicked him out over 4 months ago and my child is living with them! Now he wants to take my daughter to his new girlfriends house which is a very unfavorable situation. So now his mother keeps calling me to "get me on her side" to HELP to get HER third party custody. This would be a temporary motion to get third party custody for both of his parents. It is a long story, but I have no rights on paper because I did not go to court 6 years ago for custody because I did not get notice. I was unaware of the courtdate. When I received the courts ruling I called the father and he said that it was "no problem, dont pay any attention to those papers, we will share her". How stupid of me to think we would just work out my visitation outside of court! Anyway, I was very ill and had surgery, and was sick for about 3 years. But I am well now, remarried and stable. I let him have her on paper, because I couldnt care for her. I should have modified the plan so long ago. I know that now.

*So, I think his mother is working towartds getting me to sign something for her to get temporary, then proceed to permanent custody. She is offering me SOME minimal visitation in exchange if I work with her.

At this point I think the father , and his family are a circus. I thought everything was fine, but I just came to realize this situation has grown unfavorable for her. I want my daughter back. I am no longer sick. The family keeps trying to scare me into submission to avoid me taking them to court. It has worked for a while. I have been so stupid and scared. I want my girl back. Ill take anything I cant get to see her.

*Do I have a chance at winning custody back? Should I try to let her prove the father unfit, and then go to court? Or do I work with this woman to seek some rights, then try to go back into court after she gets temporary custody?

I am in Denver and am getting nowhere on the phone so far with how to proceed with this. Obviously I need to get in the courtroom.

Does it matter that he has a NEW breathalizer in his car? I cant find any laws that say he is unfit. Is he now unfit?

Does Anyone have any suggestions. This situation is disturbing, to say the least.
